MESURES FISCALES DE LA NC N°18/2015 RELATIFS A l’ASSOUPLISSEMENT DE L’OPERATION D’ACQUISITION OU DE CONSTRUCTION DES LOCAUX A USAGE D’HABITATION 

La loi n°2015-30 du 18 aôut 2015, portant loi de finances complémentaire pour l’année 2015 permet aux personnes physiques de déduire les intérêts payés au titre des crédits relatifs à l’acquisition ou à la construction d’un local à usage d’habitation. La déduction couvre également la marge de bénéfice payée dans le cadre des contrats de vente Murabaha.

1-Conditions pour le bénéfice de la déduction :

  Le bénéfice de la déduction susmentionnée est subordonné au respect des conditions suivantes : 

- il doit s’agir d’un local à usage d’habitation dont le coût d’acquisition ou de construction y compris les parties dépendantes (jardins, caves, garages…)  et les parties indépendantes (celliers, places de parking….),  même lorsqu’ils font l’objet de contrats séparés, ne dépasse pas 200.000 dinars ;

-il doit s’agir d’une opération d’acquisition ou de construction d’un seul local à usage d’habitation ;

-le bénéficiaire du crédit ne doit pas être propriétaire d’un autre local à usage d’habitation à la date de la déduction même en copropriété, et ce, même si la valeur totale de la première et de la deuxième habitation ne dépasse pas 200.000 dinars.
