Note d'Information Relative à la Protection des Données Personnelles chez ABC – AUDIT & BUSINESS CONSULTING
Chez ABC, Cabinet d'expertise comptable, membre de l'ordre des experts comptables de Tunisie, nous attachons une importance primordiale à la protection de vos données personnelles et au respect de votre vie privée, conformément à la réglementation tunisienne, notamment, la loi du 27 juillet 2004 relative à la protection des données à caractère personnel. Nous mettons en œuvre une série de politiques, de procédures et de sécurité permettant de préserver les données personnelles, sensibles, confidentielles et ou financières de nos clients et/ou de leurs employés. La présente note a pour objectif de vous informer de vos droits et de nos pratiques en matière de traitement de vos données, conformément à la loi tunisienne n° 2004-63 du 27 juillet 2004, relative à la protection des données à caractère personnel.
1-Informations sur le Traitement de Vos Données Personnelles :
Dans le cadre de ses activités professionnelles et contractuelles, ABC peut collecter et traiter des données personnelles et/ou financières vous concernant dans le cadre des finalités suivantes :
* Établissement des fiches de paie des employés de nos clients : Nous pouvons être amener à collecter et traiter les informations nécessaires à l'établissement de vos salaires, primes, impôts, déductions et cotisations sociales... Ces données comprennent notamment votre identité, vos coordonnées bancaires, votre numéro de sécurité sociale, les informations relatives à votre contrat de travail, à vos heures de travail et à d'autres informations nécessaires à l'établissement de vos salaires, déclarations et fiches de paie.
* Arrêté des états financiers et autres services (comptables, fiscal ou légale) : Certaines données financières ou personnelles peuvent être utilisées pour l'élaboration des états financiers de nos clients, ou leur apporter un support technique en matière fiscal, social, légal ou de management. Et ce, dans le respect des obligations légales, contractuelles , et réglementaires en vigueur. Ces données sont traitées uniquement pour les objectifs convenus avec nos clients, de manière agrégées et anonymisées lorsque cela est possible, afin de préserver votre confidentialité.
Ces traitements sont effectués sur la base des nécessités liées à l'exécution de nos obligations légales et contractuelles, ainsi que pour nos intérêts légitimes en tant qu'entreprise.
2-Obtention du Consentement des Parties Concernées :
* Employés : Dans le cadre de nos relations contractuelles avec nos clients, certaines de vos données personnelles sont nécessaires à l'exécution de votre contrat de travail et au respect de nos obligations légales. Votre acceptation des conditions d'emploi chez votre employeur implique généralement votre consentement au traitement de ces données pour les finalités susmentionnées. Pour tout traitement de données non directement lié à l'exécution de votre contrat ou à une obligation légale, votre consentement explicite sera sollicité.
Si vous travaillez pour une société étrangère ou Tunisienne qui traite ou transmet vos données à l'étranger, vous devez en être informés par votre employeur et sous sa responsabilité. Notre rôle sera de collecter, traiter et communiquer toute information demandée par votre employeur de façon sécurisée et dans les espaces qu'il aura définit dans nos relations contractuelles.
* Clients : Pour nos clients, nous pouvons être amené à collecter et traiter certaines données personnelles, financières et ou confidentielles, ... nécessaires à la fourniture de nos services (de comptabilité, de paie, de fiscalité, d'audit et de conseils de toutes natures) et à la gestion de notre relation commerciale. Votre engagement avec nos clients, implique votre consentement au traitement éventuellement de vos données personnelles pour les finalités convenues contractuellement avec votre employeur (qui est notre client). Pour tout traitement supplémentaire, votre consentement libre, spécifique et éclairé sera recueilli. Vous avez le droit de retirer votre consentement à tout moment, sans que cela n'affecte la licéité du traitement fondé sur le consentement donné avant ce retrait.
3-Droit d'Opposition des Employés :
En tant qu'employé, vous avez le droit de vous opposer, pour des raisons légitimes, au traitement de vos données personnelles, sauf si ce traitement est nécessaire à l'exécution de votre contrat de travail, à nos obligations légales ou à la protection de nos intérêts légitimes prépondérants. Pour exercer ce droit, veuillez contacter notre responsable de la protection des données aux coordonnées indiquées ci-dessous.
4-Droit d'Accès
Vous avez le droit d'obtenir d'ABC la confirmation que des données personnelles vous concernant sont ou ne sont pas traitées et, lorsqu'elles le sont, le droit d'accéder auxdites données ainsi qu'aux informations suivantes :
* Les finalités du traitement.
* Les catégories de données personnelles concernées.
* Les destinataires ou catégories de destinataires auxquels les données personnelles ont été ou seront communiquées.
* La durée de conservation des données personnelles ou, à défaut, les critères utilisés pour déterminer cette durée.
* L'existence du droit de demander la rectification ou l'effacement de vos données personnelles, ou une limitation du traitement, ou du droit de s'opposer à ce traitement.
* Le droit d'introduire une réclamation auprès de l'Instance Nationale de Protection des Données Personnelles (INPDP).
* La source des données lorsque celles-ci ne sont pas collectées directement auprès de vous.

1.Introduction
ABC Audit & Business Consulting ("ABC") takes the protection of confidential information veryseriously. This Confidentiality Policy ("Policy") outlinesourcommitment to safeguarding the sensitive data of our clients, partners, and employees.
2.Scope
This Policy applies to all confidential information disclosed to ABC by its clients, partners, and anyotherthird party during the course of our business relationship. "Confidential Information" includes, but is not limitedto:
•Client Data: Financial records, tax information, business plans, marketing strategies, customerlists, and anyother information specific to a client'soperations.
•Non-Public Information: Trade secrets, proprietary information, intellectualproperty, and anyother information not generallyknown to the public.

4.Exceptions to Confidentiality
ABC maydiscloseconfidential information in the followinglimitedcircumstances:
•Legal Obligation: Whenrequired to do so by law, court order, or otherlegal process.
•Professional Duty: To complywithprofessionalethical obligations or to report suspectedillegalactivity.
•Client Consent: With the specificwritten consent of the client to whom the confidential information pertains.
•Public Safety: To protect public safety or prevent imminent harm.
5.Consequences of Breach
ABC employees and representativeswhoviolatethis Policy willbesubject to disciplinary action, up to and includingtermination of employment. ABC willalsotakeappropriatelegal action againstanythird party thatbreaches the confidentiality obligations outlined in this Policy.
6.Client and Partner Responsibilities
Clients and partners are alsoresponsible for maintaining the confidentiality of information disclosed by ABC. This includestakingreasonablemeasures to protectsuch information and limitingaccess to authorized personnel on a "need-to-know" basis.
7.Policy Updates
ABC reserves the right to update this Policy at any time. Wewillnotify clients, partners, and employees of anymaterial changes to the Policy.
